Back at the beginning of December 2022 the Department for Business, Education and Industrial Strategy published its response to its 2021 consultation on flexible working. The media headlines gave the impression that employees would have the right to change the way they work from day one of their employment however, this is not strictly the case.

The initial consultation paper detailed a number of proposals to amend the existing legislation that gives employees with 26 weeks’ service the right to request a change to their employment contract in relation to the following areas:

The government proposals outlined the intention to give employees the right to request flexible working from day one on the job. Should these plans come to fruition, it would afford around 2.2 million more people the ability to request flexible working.
