The Mental Capacity Act 2005 (MCA) was fully implemented in 2009 and applies to people who live in England or Wales. It is a framework for people over 16 years old who do not have the capacity to make decisions on their own. It is also for people who have a responsibility to make decisions on other people's behalf. The dental team is in a position where team members may need to assess someone's capacity to make informed decisions about their treatment, and hence it is invaluable and essential that you understand the Mental Capacity Act. The Act applies to all people making decisions for those who may lack capacity to make a particular decision. These people are called ‘decision makers’.
